1. The nature, contents, condition, and value of the consignments are not known to the carrier, and the goods are carried as packed and declared by the consignor at “Owner's Risk.”

2. The carrier does not guarantee delivery within any specified time, and the carrier shall not be liable for any delay in transport or delivery not due to any negligence or default of the carrier or his agents or servants.

3. In the event of an interruption of any route, the carrier shall have the discretion to send the goods by the next available open route, at the same freight, and the same terms and conditions under which the goods are originally accepted.

4. Goods are to be insured by the party to protect their interest.

5. The carrier has the right to transport the consignments in part or the whole distance by road, rail, or water or in their own vehicle or hired vehicles. In case the goods are entrusted to another carrier, the other carrier shall be deemed to be the carrier’s agent and continue to be responsible for the safety of the goods and for their due delivery at the destination.

6. The carrier shall not be responsible for any loss or damages due to pilferage, theft, weather conditions, strikes, riots, disturbances, fire, explosion, or accidents. However, all reasonable precautions usually taken are taken by the carrier against such contingencies.

7. The carrier shall not be responsible for the damage to the contents of the packages, which are outwardly in sound condition or for damages or shortages of goods or goods not properly packed.

8. The carrier shall not be responsible for breakages of fragile materials, deterioration of perishable articles, or for leakage of liquids, or evaporation of gases and all insurable risks from whatever causes. Even if insured, the insurance company shall not have recourse against the carrier for such claims.

9. The consignees are to ascertain from the destination points, the date of arrival of their goods, and take delivery of the same from the company’s go-down within the grace period allowed for each region. Failing which, go-down rent by way of demurrage will be charged according to the rates prevailing from time to time at different areas.

10. The consignee shall pay the delivery charge at the time of taking delivery of consignments, as per the rate in force, from time to time at different offices.

11. The carrier undertakes to deliver the goods as received to the consignee or to his order or his assignees on the relative consignee copies being surrendered to the carrier duly discharged or against a proper indemnity bond if the relevant GCN is lost. Only the consignor or holder for the value of the receipt who is entitled to delivery as aforesaid shall have the right of recourse against the carrier for all claims arising thereof.

12. The carrier has the right to reweigh, remeasure, reclassify, and recalculate rates at the place of destination and to collect before the goods are delivered, any among them that may have been omitted or undercharged at the time of booking.

13. The minimum weight chargeable for a single consignment shall be 50 kgs, and weight above shall be rounded off in multiples of 10 kgs for the purpose of freight calculation.

14. The carrier reserves the right to refuse any goods for transport without assigning any reason.

15. The carrier shall have the right to dispose of perishable lying undelivered after 48 hours of arrival without any notice, and other goods, if in saleable condition, after 45 days of arrival and after giving due notice in writing, to the consignor or the holder known to be interested, and the claimant shall be entitled to the proceeds less freight and demurrage and other dues due to the carrier, or if any balance is due the carrier after setting off the proceeds towards the dues, the consignors or the party concerned shall be liable to pay the same to the carrier. Goods remaining in unsalable condition shall be discarded and removed from the go-down.

16. The consignor is responsible to provide all necessary forms, invoices, permits, etc. required under law for checking by Government Authorities, at check posts and other places, and the carrier is not responsible if the goods are retained or seized or confiscated by the Government Authorities for any reason. If any action is taken against the carrier or its servants for defective documents or for want of documents, the consignor will be responsible for the same, and the goods will be withheld by the carrier until the loss sustained or the expense incurred by the carrier on account of the aforesaid action is fully settled by the consignors. The carrier shall be at liberty to detain such consignments if there is a reason for suspicion that a wrong declaration of content is made in the goods forwarding note by or on behalf of the consignor. The consignor shall also be liable to fully indemnify the carrier for the consequences arising out of the wrong declaration given.

17. The carrier does not undertake to rebook consignments from the destination point. If the carrier rebooks at the special request of the consignor, the carrier rebooks at the special request of the consignor, the carrier shall not be liable for any claim arising out of the rebooking or the rebooked consignment.

18. No claim shall lie against the carrier unless it is supported by an open delivery certificate to be issued by the delivery station.

19. No inquiry will be entertained relating to any consignments after the expiry of 30 days from the date of delivery.

20. No suit or other legal proceedings shall be instituted against the carrier for any loss of, or damage to, the consignment unless notice in writing of the loss or damage to the consignment has been served on the carrier before the institution of the suit or other legal proceedings and within 180 days from the date of booking of the consignment by the consignor.

21. The carrier is not liable for damages occurring to the goods stored in our godown beyond 10 days.

22. The courts in Kozhikode City alone shall have authority to entertain and judge upon all claims and matters relating to the consignments of the goods entrusted for transportation under this receipt.
